Mobile Worker complies with the EU Data Protection Directive and the Norwegian Data Protection Authority on Data Protection.
Who we are and what this is
Mobile Worker (hereinafter – MW) is the owner and producer of Mobile Worker software, which are collaborative web and mobile based applications that help businesses gather data such as time, expenses, and other field services related data.
MW processes personal data of the Customer (legal entities, MW clients, and natural persons, MW Sites’ and Services’ users) in accordance with this Policy, license agreement between the Customer and MW (hereinafter – License agreement), the EU Common Data Processing Regulation and other legal acts regulating the protection of personal data.
We collect, use and store personal data in compliance with the GDPR (General Data Protection Regulation) principles, therefore, we apply organizational and technical measures that ensure adequate personal data protection, including protection against unauthorized or illegal processing of data, and protection against unintentional loss, destruction or damage.
This Policy governs the manner in which MW collects, uses, maintains, destroys and discloses information collected from Customers that becomes available to MW as Customers use our services and the choices you have associated with that data.
Scope and Data subjects
This Policy applies to all MW business areas including use of the www.mworker.com and www.mworker.no websites (hereinafter – Sites), and software solutions – Web application and Device application (collectively referred to here as the/our “Software” or the/our “Service”).
This Policy applies to all types of Customers’ contact persons who provide personal identifying information.
By providing MW with personal data Customer accepts the terms of this Policy. If you do not agree with how we process personal data, please do not use our services.
MW, providing its services, acts both, as a personal data controller and as a personal data processor.
Data controller means a natural or legal entity, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
MW acts as data controller when you provide us with your data for these purposes:
- For direct marketing purposes, MW processes Customer/Lead (natural person) data, received upon ordering the newsletter at Sites or in public fairs.
- For the purpose of administering queries, MW processes Customer/Lead (natural person) data, received via the Site or MW blog requesting information about Services or other similar matters.
- For the purpose of internal administration MW processes personal data of its employees.
This Policy outlines the details of how MW acts as data controller.
Data processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
As a data processor MW handles personal information for these purposes:
- For the purpose of software modules license issuance and software maintenance,
- For the purpose of ordering the demo/trial version of the software.
- For the marketing purposes.
Our Customers become data controllers in these situations. MW licence agreement regulates the details of the relationship between Customer as data controller and MW as data processor.
Information we collect
Generally, you control the amount and type of information you provide to us when using our Sites.
As a Visitor, you can browse our Sites to find out more about our Services. You are not required to provide us with any Personally Identifiable Information as a Visitor.
We collect information to be able to provide better services to all our Customers. Below are the ways that we collect information.
Personal information is any information that could allow us to identify an individual and you give us yourself. For instance, you request us an information about our Services, sign up for our newsletter, or create an account to use our Software.
Via our Sites and/or Software we may collect the following personally identifiable information for marketing and queries purposes:
- name and surname of the contact person
- and/ or e-mail address
- and/ or phone number
For the purpose of ordering the demo/trial version of the Software or licence of the Software modules issuance, MW processes the following personal data of the Customer:
- name and surname of the Customer contact person,
- telephone number of the contact person (optional),
- e-mail address of the contact person,
As data controller MW does not process any sensitive data about the Customers. As data controller Customer might add more personal data of its employees such as:
- date of birth of the contact person (optional, only if required by the law for certain Software modules),
- location data of the contact person (upon Customer agreement to provide this data),
- and other depending on company needs to perform work tasks.
While using Sites and Software MW is provided with general non-personally-identifying information about the services you use and how you use them to be able where possible improve experience of our Services.
We may collect information that your browser sends whenever you visit our Site or use our Services or when you access the Service via a mobile device (“Usage Data”).
This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, language preference, referring site, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. We don’t use that information to identify you.
When you access the Service via a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customize our Service.
You can enable or disable location services when you use our Service at any time, through your device settings.
Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are scripts to collect and track information and to improve and analyse our Service.
The length of time a cookie will stay on your browsing device depends on whether it is a “persistent” or a “session” cookie. Session cookies will only stay on your device until you stop browsing. Persistent cookies stay on your browsing device until they expire or are deleted.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service or at all. We never place Personally Identifiable Information in Cookies. Cookies do not typically contain any information that personally identifies a user, but personal information that we store about you may be linked to the information stored in and obtained from cookies.

How we use information we collect
We use the information Customers provide to offer tailored services and improve the services we offer to the Customers.
Here are some of the ways we may use personal information you provide us:
- To send informational and promotional content about our Services to Customers that granted us permission to do so
- To allow Customers to create our Software account and to administer and process the registration
- To send Customers system alert or notification messages
- To communicate with our Customers about their account and provide customer support
- To communicate with Customers about our products, services, their changes and related issues
- To evaluate the quality of our products and services, and to enhance Customers experience on our Sites
- To provide, maintain and administer our Sites and Services, and comply with our legal or internal obligations and policies
- To monitor and gather analysis about the usage of our Services
- To detect, prevent and address technical issues
- To provide information to others as described in this Policy
- To meet legal requirements
MW collects, manages and stores personal data of the Customer in such scope and for such purposes as provided in this Policy. MW aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.
Ability to opt-out of marketing communications
You may request to discontinue sending marketing information by unsubscribing from our mailing list from any received e-mail or by contacting us at firstname.lastname@example.org.
Please note that even if you are removed from marketing communications list but you are our Services Customer, you might still receive administrative communication about product updates, system notification, confirmations on your orders or response to your support questions.
Whenever made possible, you can update your Personal Data directly within your Software account settings section. If you are unable to change your Personal Data, please contact us to make the required changes.
If you wish to be informed what Personal Data we hold about you and/or if you want it to be removed from our systems, please contact us via email@example.com.
In certain circumstances, you have the right:
- to access and receive a copy of the Personal Data we hold about you,
- to rectify any Personal Data held about you that is inaccurate,
- to request the deletion of Personal Data held about you.
MW, upon the receipt of the Customer’s request to access the processed personal data, shall submit the answer within a period of 30 (thirty) days from the receipt of the request. The answer shall be submitted free of charge.
After getting acquainted with the personal data being processed, you have the right to request to stop processing personal data and / or delete personal data, or to correct and/or supplement the data by contacting us at firstname.lastname@example.org. MW verifies the request of the Customer and, if the request is found justifiable, MW satisfies such request without undue delay but no later than within 5 business days and notifies the Customer by e-mail about the completed actions.
Customer has the right to require MW to “forget” processed personal data, in particular, to delete all personal data, unless the data is necessary for the purpose for which it was collected and processed or if the Customer cancels the given consent, or if the data are processed in violation of the requirements of the legislation. MW satisfies such request without undue delay but no later than within 5 business days and notifies the Customer by e-mail about the completed actions.
Customer, having considered that MW actions of processing his/her personal data have violated his/her legitimate rights and interests, has the right to apply to the Norwegian Data Protection Authority.
Please note that we may ask you to verify your identity before responding to such requests.
Disclosure of Data
Under certain circumstances, MW may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court order or a government agency). Attorney must be provided with the data of the Customer only upon submission of the representation agreement (a notarized authorization) and indicating the reasons of the use of the data.
MW organizes the work process in such a way as to ensure the safe handling and / or transfer of computer data and / or documents.
Access to the Customer’s personal data is granted only to those MW employees who need it to perform work functions and only to those who have signed confidentiality agreements and are familiar with other internal procedures in the scope of personal data processing and protection.
Personal data is protected against loss, unauthorized use and alteration. The Internet connection is encrypted and the Site and Software is accessed via the HTTPS protocol.
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
Personal data received for direct marketing purposes or as queries request from Customer’s (natural person) is stored for 5 (five) years from the date of submission. However, as stated in Customer rights section you are free to opt-out of this list any time.
Personal data received for Software licence issuance is stored for 3 (three) months from the date of termination of the License agreement, unless License agreement specifies otherwise.
Customer (natural person) may revoke the given consent to process his/ her e-mail for direct marketing purposes by clicking on the link in each newsletter or by contacting MW by email@example.com.
Links to Other Sites
We do not sell, rent, or otherwise provide your Personally Identifiable Information to third parties for marketing purposes.
MW uses subcontractors to process personal data and may export Customers data outside the EU in this regard. These subcontractors are typically vendors of cloud services or other IT hosting services. Such affiliates will only receive information necessary to provide the respective services and will be bound by confidentiality agreements limiting the use of such information and are obligated not to disclose or use it for any other purpose.
When using subcontractors, MW will enter into a data processing agreement (DPA) with subcontractors to safeguard your privacy rights and to fulfil our obligations towards our Customers. When subcontractors are located outside the EU, MW ensures that third parties operate under trusted data protection laws.
The following third parties are our outside EU partners in helping us provide our Services:
- Microsoft Azure (US), provider of technical platform for our cloud services (cloud service resides in EU), our email, office automation and file storage solution.
- Dropbox (US), provider of file storage solution.
- MailChimp (US), newsletters sending provider.
- HubSpot (US), inbound marketing and sales platform provider.
Our Service does not address anyone under the age of 13 (“Children”).
We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us at firstname.lastname@example.org. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.
Changes to the Policy
In case of significant changes in our Policy, we might send a notification of changes by other means like sending an e-mail or communicating via newsletters prior to the changes are effective.
